According to an article that was posted today on Etsy's blog, the CPSCA released the following information:
"The new law requires that domestic manufacturers and importers certify that children’s products made after February 10 meet all the new safety standards and the lead ban. Sellers of used children’s products, such as thrift stores and consignment stores, are not required to certify that those products meet the new lead limits, phthalates standard or new toy standards.
The new safety law does not require resellers to test children’s products in inventory for compliance with the lead limit before they are sold. However, resellers cannot sell children’s products that exceed the lead limit and therefore should avoid products that are likely to have lead content, unless they have testing or other information to indicate the products being sold have less than the new limit. Those resellers that do sell products in violation of the new limits could face civil and/or criminal penalties."
So, we should still be careful about selling items that might actually contain high amounts of lead - but, our Little Golden Books, dolls and clothing shouldn't be a problem...

Alas, and alack, are you willing to face prison or financial penalty up to $100,000 for selling a Golden Book?
Are you willing to live in fear because some Congressperson (actually all of them) didn't read the bill that became CPSIA before they voted and didn't remember there's a secondhand market?
You're not exempt. You are now (well, after Feb 9 2009) living under a black cloud of threat of criminal arrest. The Federal government just made your livelihood subject to criminal retaliation. Who's to say that someone with issues about you or your business isn't going to call the Feds down on you?
We in the resale industry have been fighting to get Congress to void this well-intended law for its many flaws. The chances we'll succeed in pointing out to Congress their errors? Little to none, of course. But getting folks like your readers MAD will help... Repeat:
RESELLERS ARE NOT EXEMPT FROM CRIMINAL PROSECUTION IF THEY SELL ANYTHING THAT WAS DESIGNED AT ANY POINT IN TIME TO APPEAL TO CHILDREN, AND THAT CONTAINS 601 OR MORE PPM LEAD.
